How does POSITIVE SOLUTIONS, acting as data controller, collect, store and process your personal data? 

Preamble 

POSITIVE SOLUTIONS understands the need to keep personal data confidential. It has chosen to set out the commitments it intends to make on protecting personal data by adopting this privacy policy (hereinafter the "Policy").

This Policy applies to all personal data that POSITIVE SOLUTIONS processes when it acts as data controller. 

I. The data controller 

POSITIVE SOLUTIONS SAS (hereinafter "POSITIVE SOLUTIONS" or "nous") is a simplified joint-stock company with capital of €512,041.00, with its registered office at 73 Allée Kléber – 34000 Montpellier.  

It is listed in the Montpellier Trade and Companies Register under no. 918 987 652. Its intra-EU VAT number is FR 62918987652.

II. Purposes, retention periods and legal bases 

What do we use your personal data for? 

Authorised POSITIVE SOLUTIONS staff may process your personal data for a number of purposes. 

Each purpose has a "legal basis" that justifies our processing. 

We also keep your data for a set period, which depends on the purpose. We express this period as an "active phase", when we actually process your data to meet the purpose described in the table, and as an "intermediate archive", when we keep the data with restricted access. We no longer use archived data for the purpose as such, but we still keep it to meet a legal obligation and/or to let us defend our rights in court if needed.

Who do we share your personal data with? 

We may transfer and disclose your data to: 

  • Any company and/or partner to whom we must pass on your personal data — with your agreement — in particular for events and/or conferences; 
  • Any company that issues a consultation or a tender we respond to, so that this company can contact you for information on how we delivered the service. In this case, we share your contact details (surname, first name, email address and telephone number); 
  • Our IT service providers, for example to host this site, host software (such as a CRM), carry out maintenance, etc.; 
  • Your employer; 
  • Any company with which we have direct and/or indirect capital ties (for example if we restructure, acquire other companies or merge with other companies), or any company that acquires all or part of a company with which we have direct and/or indirect capital ties; 
  • Regulators, the TRACFIN unit, independent administrative authorities or dispute-resolution bodies, to meet their requests; 
  • Companies that carry out commercial or market studies for us; 
  • Any other person involved in a dispute; 
  • Judicial or administrative authorities and courts. 

Some of these recipients sit outside the European Union, in particular in the United States. When that is the case, we rely on the European Union's standard contractual clauses. 

What are your rights over your personal data? 

Depending on the circumstances, you have rights over the personal data that concerns you, in particular: 

  • The right to get information about the processing we carry out and the data we hold about you, along with a copy of that data; 
  • The right to withdraw your consent to the processing of your personal data at any time; 
  • The right to have your data corrected; 
  • The right to confirm whether or not your personal data is still being processed; 
  • The right to ask us to delete your data; 
  • The right to ask us to restrict, or to object to, the processing of your data.
