How is your personal data collected, stored and processed by POSITIVE SOLUTIONS in its capacity as data controller? 

Preamble 

Aware of the need to ensure the confidentiality of personal data, POSITIVE SOLUTIONS wished to formalize the commitments it intends to make with regard to the protection of personal data by adopting the present confidentiality policy (hereinafter the "Policy")

This Policy applies to all personal data processed by POSITIVE SOLUTIONS, when acting as data controller. 

I. Presentation of the data controller 

POSITIVE SOLUTIONS SAS (hereinafter, "POSITIVE SOLUTIONS" or "we") is a simplified joint stock company with capital of €512,041.00, whose registered office is located at 73 Allée Kléber - 34000 Montpellier.  

It is registered in the Montpellier Trade and Companies Register under no. 918 987 652. Its VAT number is FR 62918987652.

II. Purposes, retention periods and legal basis 

What do we use your personal data for? 

Your personal data may be processed by authorized POSITIVE SOLUTIONS personnel for a number of purposes. 

Each of these purposes is associated with a "legal basis", which justifies our proceeding with the processing. 

Your data is also stored for a predetermined period, depending on the purpose of processing. This period is expressed as an "active base", which corresponds to the stage at which your data is actually processed in order to achieve the purpose described in the table, and as an "intermediate archive", which corresponds to a state of conservation of the data with restricted access. Data archived in this way is no longer used for the purpose for which it was intended, but is nevertheless retained in order to comply with a legal obligation and/or to enable us to defend our legal rights, if necessary.

With whom do we share your personal data? 

We may transfer and disclose your data to : 

  • Any company and / or partner to whom we need to transmit - with your consent - your personal data, in particular on the occasion of events and / or conferences; 
  • Any company formulating a consultation or a call for tender to which we respond, so that this company is able to contact you to obtain information on how we have delivered the service. In this context, we communicate your contact details (surname, first name, e-mail address and telephone number); 
  • Our IT service providers, for example in connection with the provision of hosting services for this site, software hosting (e.g. CRM), maintenance, etc. ; 
  • Your employer ; 
  • Any company with which we have direct and/or indirect capital ties (e.g. if we restructure or acquire other companies or merge with other companies) or any company that acquires all or part of a company with which we have direct and/or indirect capital ties; 
  • Regulators, TRACFIN, independent administrative authorities or dispute resolution bodies, in order to comply with their requests; 
  • Companies that carry out commercial or market research for us; 
  • Any other person involved in a dispute ; 
  • Judicial or administrative authorities. 

Some of these recipients are located outside the European Union, notably in the United States. Where this is the case, we rely on the European Union's standard contractual clauses. 

What are your rights with regard to personal data? 

Depending on the circumstances, you have the following rights with regard to your personal data: 

  • The right to obtain information on the processing carried out and the data we hold on you, as well as a copy of the latter; 
  • The right to withdraw your consent to the processing of your personal data at any time; 
  • The right to obtain rectification of your data; 
  • The right to obtain confirmation that your personal data is or is no longer being processed; 
  • The right to ask us to delete your data; 
  • The right to ask us to restrict or object to the processing of your data.
